Following the judicial invalidation of the “Safe Harbor” Decision, the “EU-US Privacy Shield”, adopted by the European Commission on July 12, 2016 sets out the new regulatory framework applicable to data transfers from European Union to the United States in order to guarantee an adequate level of protection similarly to the European model.

 

 

 

The widespread use of social networks (e.g. Facebook or LinkedIn) or commonly used messaging services (e.g. Whatsapp), continues to affect the workplace, and their inappropriate use can now lead to disciplinary dismissals that have been declared admissible by a number of High Courts of Justice.

 

 

 

We shall analyse the “Sum insured” clause as grounds for contesting the direct action referred to in article 76 of the Insurance Contracts Act [Ley de Contrato de Seguros, or LCS].
